I. Customer withdrawal. Product Returns
1.1 If the purchaser finds that the product received deviates from the characteristics mentioned in the order (eg different food, different portions, etc.), the packaging is damaged, the product appears to be unfit for human consumption or is incomplete, he has the right to request the replacement of the product to the seller or to reimburse it. The complaint regarding the condition of the products must be communicated upon taking possession of them, by telephone or by e-mail at firstname.lastname@example.org, and will be resolved after the condition of the products has been verified. If the verification shows that the products do not comply with the requirements mentioned by the customer in the order, the products are replaced, if they are still in stock, or the seller undertakes to return the full amount and not resell the non-compliant products to another customer. The seller will reimburse all amounts received as payment from the buyer within 48 hours of being informed of the decision to withdraw from the contract, using the same payment methods as those used by the buyer for the initial transaction. .
1.2 As the products contain fresh and perishable food, the Buyer does not have the right to withdraw from the contract or to return the products without having to justify the withdrawal decision, except as expressly provided in these Terms and Conditions.
II. Prices and payment methods
2.1 All tariffs related to the products presented on the site, on the page dedicated to each product, are expressed in lei (RON) according to the legislation in force.
2.2 The price, payment method and payment term are specified in each order.
2.3 The administrator is concerned that the prices displayed in the online store are correct, but in the event that, in error, a marketed and ordered product has an incorrectly displayed price, the administrator will inform the buyer of this circumstance. If the actual price is lower than the displayed price, the product will be billed at the actual value. If the actual price is higher, the buyer will have the option to pay the actual price or cancel the placed order.
2.4 In case of registration of an order with a derisory price, due to a technical or material error, the seller has the right to cancel the order.
2.5 Discounts, discounts and promotions are not cumulative and are expressly stated by the seller. The discount with the highest value is always kept. The seller establishes the rules of the promotions and contests that he organizes. These rules are made known to potential participants only through the site. Promotions made by the seller are subject to O.G. no. 99/2000 and they may be subject to change depending on the marketing campaigns implemented. Only promotions that follow exactly the rules displayed on the site benefit from these promotions. Also, promotions apply only to orders that are registered within the time period specified in the regulation and in which the promotion is valid and only within the available stock. The seller does not guarantee the availability of the products for the promotion and may interrupt or cancel it at any time without prior notice.
2.6 The price printed on the invoice / tax receipt is the same as the one sent by the seller at the time of order confirmation.
2.7 The seller will issue the invoice in electronic format, according to the provisions of art. 319 para. (4) of the Fiscal Code, and the buyer declares that he accepts the use of the electronic invoice. The invoice will be communicated to the buyer at the e-mail address chosen for communication. The products are accompanied at the time of delivery of the tax receipt.
2.8 The buyer has the following payment methods:
- Online with your debit or credit bank card when placing your order. Accepted cards for online payment of products are: Visa, Visa Electron, Mastercard / Eurocard, Maestro, including Visa and Mastercard virtual cards; the seller has the right to cancel the order if the transaction has not been accepted by the bank issuing the buyer’s card.
2.9 In case of payment by bank card, if the payment has been processed and as a result of stock synchronization it proves to be exhausted, the seller will contact the customer and return the amount paid by him or, at the express request of the customer, will offer other products instead, of those in stock.
2.10 Delivery and packaging of products are free of charge.
III. Product Delivery
3.1 The products available in stock and listed on the site will be physically delivered to the specified address, through our own staff / express courier services, only in Romania. Deliveries are made door-to-door. The courier through which the delivery of the ordered products will be made is chosen by the seller, unilaterally. The seller may at any time change the courier who will deliver the products ordered by the buyer.
3.2 The seller will ensure the proper packaging of the products.
3.3 The products will be delivered to the address indicated by the buyer. The seller provides free shipping of orders.
3.4 The delivery time for the products ordered through the site is for Cluj Napoca maximum 160 minutes and nationally 72 hours from the moment of confirmation of the order by the seller.
3.5 Orders are placed before delivery until 16:00.
No orders or deliveries of orders are made on Sundays and public holidays.
3.6 The ordered products will be delivered between 9:00 and 17:00, depending on the route of the courier. The seller cannot guarantee a fixed delivery time.
3.7 The administrator may delay or cancel the delivery of the products if he cannot fulfill the order for reasons beyond his control, caused either by a third party or by force majeure.
3.8 There may be delays compared to the delivery time set at the time of order confirmation; in this case, the seller does not assume any responsibility on behalf of the courier.
3.9 If the seller, after confirming the order, does not deliver the products between 9:00 and 17:00, and the buyer has chosen to cancel the order, the seller will refund without undue delay all amounts paid under the contract by the buyer. and within a maximum of 3 days from the date on which the buyer communicated to the seller his decision to terminate the contract.
3.10 The risk of loss of or damage to the goods is transferred to the buyer when he or a third party designated by him, other than the carrier, takes physical possession of the goods.
3.11 The ownership of the products is transferred to the buyer upon delivery, subject to payment of the price.
3.12 If the product cannot be delivered for reasons attributable to the buyer, the seller reserves the right to collect the amount of the ordered product.
IV. Buyer Obligations
4.1 The buyer undertakes to read, accept and comply with the terms and conditions of the seller with the use of the site and the launch of orders and to pay for the products ordered by the methods provided by the seller.
4.2 The Buyer undertakes to provide real, accurate and current information about his identity for the creation of the User Account and when requested, otherwise there is a possibility to refuse orders; The buyer can modify, complete or update his credentials by accessing the My Account section. The seller has the right to cancel the order if the buyer’s data is incomplete.
4.3 The Buyer has the obligation to update the data in the User Account whenever necessary.
V. Obligations of the seller
5.1 The seller undertakes to contact customers to confirm orders by e-mail.
5.2 The seller undertakes to deliver the products within 72 hours of the order being confirmed.
VI. Delivery terms
In order to benefit from free shipping, the minimum order must be respected for the following areas:
- (Zone 1) Zorilor Zone: The minimum order is 100 Ron
- (Zone 2) Areas Marasti, Manastur, Hello, Grigorescu, Gheorgheni: Minimum order is 150 Ron
- (Zone 3) Baciu, Floresti, Someseni, Dezmir areas: The minimum order is 250 Ron
Otherwise, shipping must be paid for, as follows:
- (Zone 1) Zorilor Zone: Transport cost 10 Ron
- (Zone 2) Areas Marasti, Manastur, Hello, Grigorescu, Gheorgheni: Transport cost 15 Ron
- (Zone 3) Baciu, Floresti, Someseni, Dezmir areas: Transport cost 25 Ron
